1. Acceptance
By accessing or using the Smart Sales Spaces platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Service description
Smart Sales Spaces is a B2B SaaS platform for real estate developers, providing touchscreen kiosks, virtual 3D property maps, and analytics for the sales of residential and commercial developments.
3. Accounts & subscriptions
Access to the Service requires an active subscription. Customer is responsible for maintaining the confidentiality of account credentials and for all activity under its account.
4. Acceptable use
Customer agrees not to misuse the Service, including (without limitation) attempting to disrupt the Service, uploading unlawful content, reverse-engineering the platform, or using the Service to violate any applicable law.
5. Intellectual property
The Service, including all software, designs, and trademarks, remains the exclusive property of Smart Sales Spaces. Customer retains all rights, title, and interest in the content it uploads to the platform.
6. Customer data
Customer is solely responsible for the accuracy, legality, and appropriate use of the unit data, pricing, media, and other content it uploads. Smart Sales Spaces does not verify customer-supplied content.
7. Limitation of liability
Smart Sales Spaces is not a legal, tax, financial, or real-estate advisor. The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Smart Sales Spaces is not liable for indirect, incidental, or consequential damages.
8. Service modifications
We may modify, suspend, or discontinue features of the Service at any time. Material changes will be communicated to active customers in advance.
9. Termination
Either party may terminate the agreement in accordance with the subscription terms. Upon termination, customer retains the right to export its data within a reasonable period.
10. Governing law
These Terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the competent courts of Monterrey, Nuevo León, México, waiving any other jurisdiction.
